A History of Law and Economics, 1870 - 1970: Property, State, and the Market

Dina Waked

Séminaire de l'École de droit

I will present parts of an ongoing project on law and economics. It is a project aiming at producing a history of law and economics from the 1870s to the 1970s. This history I narrate through three paradigm shifts that shape and reshape the perpetually dialectic relationship between economic and legal thought. I will present the part of the story that focuses on the genealogy of the public interest and how it has played a role in giving rise to alternative conceptions of property, the state and the market.
