At a moment when both the President and the Supreme Court in the U.S. are trying to erase the history of slavery and racism, and erase the memory of an emancipatory Constitution, how do we as legal scholars write about history and memory? At a time when the U.S. Court is using a distorted idea of “history and tradition” and “original meaning” to achieve instrumental ends, what do legal historians have to offer legal scholarship?
