Law and Methods Seminar
Invited Guest: Professor Poul F. Kjaer, Department of Business Humanities and Law, Copenhagen Business School
The dual episteme of law and economics and human rights law has dominated legal scholarship in the last 50 years. A dual episteme which is largely of a US-American origin. Societal developments unfolding throughout the globe have, however, increasingly put its functionality and normative desirability into question. This opens for the question what episteme will succeed it. Here transformative law is emerging as a contender. An episteme which has the legal concept of sustainability at its core. In the talk I will outline key features of transformative law and then explore the question of methods in relation to transformative law. The argument advanced is that transformative law ideally should be based on triangulation of legal dogmatics, social scientific methods, and general theories of society. A triangulation which makes it fundamentally different than the dual episteme of law and economics and human rights law.
The conference takes place in room 410T (13, rue de l'Université) and online.
Invite-only event.
