Law and Methods Seminar

Invited guest: Professor Günter Frankenberg

The session will have the goal to describe Professor Frankenberg’s longstanding intellectual attempts at making legal comparison more interesting and engaging than the positivist discipline of comparative law. We will also touch upon the different theoretical, methodological and pedagical steps of this "project" (based on a forthcoing publication with Fernanda Nicola, American University). These steps include three methodological moves (history, culture, language) advanced to make the comparatist aware of her position, perspective, and selection process. The book (and discussion) will also lay out three more technical turns (the spectrum, layered and transfer approaches).
