The Innovation Theory of Harm in EU Merger Control

Ana Hergouth is graduate of Sciences Po Law School. Having interned at various law firms specialized in competition law both in Paris and Brussels and with a master’s degree in economic law, Ana Hergouth is currently training to become an attorney at the Paris Bar.
What are the market conditions under which innovation is hampered? And what are the conditions that best incentivise players to innovate? It seems that these questions, without a definite answer in either law or economics, have been keeping the competition law community busy around the world, especially in the aftermath of the Dow/DuPont and Bayer/Monsanto mergers.
Ana will present her research on the relationship between competition and innovation, the innovation theory of harm in merger control and its implications for judicial review. Her presentation will be followed by a discussion with the participants.
