Armed combatant and leader of the Hizbul Mujahideen Burhan Wani was killed by the Indian Army in July 2016. This killing triggered a new phase of insurgency in Kashmir. In the Valley, the local populace started mobilizing against the Indian State in the name of azadi, (freedom). In such volatile context, the production of the national sentiment of the Kashmiris is documented from a distanciated perspective. Frontiers of the national group are explored from New Delhi, as well as the logics of differentiation and otherification of the Kashmiri group towards the Indian one. Kashmiri nationalism therefore more clearly appears in a negative definition (what a Kashmiri is not) than in a positive definition (what a Kashmiri is). The slight and incremental slip of the meaning of azadi demands is at the heart of Kashmiri nationalism. From an original demand for greater autonomy within the Indian Republic, demands of azadi now refer to the independence of the Valley – yet there are nuances that will be studied. They also convey an utter rejection of “Indianess” whether national or citizen. In that respect, New Delhi’s negating the political aspect of the mobilizations that are taking place in the Kashmir Valley has dramatically fuelled the national sentiment of the Kashmiris. The current insurgency that started in July 2016 has sped up the pace of the process. Despite the escalating tensions in the Valley, New Delhi keeps refusing to consider the political dimension of the local social movements, be they violent or peaceful. That is the reason why, beyond Kashmir and Kashmiris themselves, studying the political demands of the Kashmiri population does shed a light on the functioning of the Indian nation and the Indian state.
Youth delinquency has been a hot topic in Russian society for many years. Numerous associations, NGOs and international organizations have raised public awareness of the problem and have encouraged the government to place judicial reform on its agenda. However, debate over how to apply it, the various possible models and how to structure the relationship between social and judicial institutions has been limited. Discussion has instead focused on the relative priorities to be given to the interests of children versus those of the family, so-called “traditional” versus “liberal” values, and the extent to which the State should interfere in the private lives of Russian citizens. Discussion of the actual situation of children at risk and the concrete problems posed by reform have been overshadowed by rumors, encouraged by a discourse of fear in an increasingly violent society that tend to distort the real problems. Additionally, implementation of international norms and judicial reform has been largely blocked by the patriotic agenda of the State.
Many online newspapers were created in Russia during the early 2000s, which gave rise to hopes concerning further developments of media pluralism. Their day-to-day operations differ little from those of their Western counterparts. They are subject to the same technical possibilities and to the same financial limitations. Under the increasingly authoritarian Russian regime, however, these common constraints can become political. Economic constraints on editorial boards, limitations on their sources of advertising revenue, administrative requirements, and surveillance of Internet providers are all tools used for political purposes. This article uses the examples of the major news sites that are lenta.ru and gazeta.ru, and the more specialized sites, snob.ru and grani.ru, to show how this political control is based on the diversity of ordinary constraints, which procedures and justifications are both unpredictable and dependent on the economic situation. The result is that political control is both omnipresent and elusive, constantly changing.
In March 2011, the transfer of power from the junta of general Than Shwe to the quasi-civil regime of Thein Sein was a time of astonishing political liberalization in Burma. This was evidenced specifically in the re-emergence of parliamentary politics, the return to prominence of Aung San Suu Kyi elected deputy in 2012 and by the shaping of new political opportunities for the population and civil society. Yet, the trajectory of the transition has been chiefly framed by the Burmese military’s internal dynamics. The army has indeed directed the process from the start and is now seeking to redefine its policy influence. While bestowing upon civilians a larger role in public and state affairs, the army has secured a wide range of constitutional prerogatives. The ethnic issue, however, remains unresolved despite the signature of several ceasefires and the creation of local parliaments. Besides, the flurry of foreign investments and international aid brought in by the political opening and the end of international sanctions appears increasingly problematic given the traditional role played in Burma by political patronage, the personification of power and the oligarchization of the economy.
As the European Union has become ever more powerful in terms of political output, it has also turned out to be a potential source of human rights violations. While national governments have disagreed on setting up consequential control mechanisms for several decades, the European Court of Justice and the European Court of Human Rights pre-empted intergovernmental choice. The European courts’ paths unexpectedly crossed when they were both impelled to work out a way to deal with a twofold human rights conundrum situated at the EU level. Turbulent interaction between Europe’s two supranational courts has not only led to a relative improvement of the protection of human rights, but has also deeply transformed the course of European integration. The courts’ increasingly nested linkage has given rise to new forms of supranational judicial diplomacy between European judges. As a result of their evolving relationship, which is simultaneously underpinned by competitive and cooperative logics, the traditional opposition between an “economic Europe” and a “human rights Europe” has been overcome and the EU’s accession to the European Convention on Human Rights is high on the political agenda. Yet, this process of integration through human rights remains a fragile and incomplete endeavour. Just as in co-operative binary puzzles where two players must solve the game together and where both lose as one of them tries to win over the other, solving Europe’s binary human rights puzzle has required of European judges a new way of thinking in which it’s not the institutions, but their linkage that matters.

This paper examines how the World Conference against Racism in Durban 2001 intensified an old debate in India about caste and race. The controversy arose after the ‘National Campaign on Dalit Human Rights’ wanted to present caste discrimination in Durban as equivalent to racial discrimination. The Indian government protested, and distinguished sociologists entered the fray by claiming that race is a western concept which cannot be compared to caste, strengthening the official position. Conceptual logic became central to the debate. First, the position represents conventional knowledge, which reflects the anti-colonial attempt to define race as being irrelevant to India. But, secondly, the scholarly discourse acted to exclude oppression from the debate in clear contrast to the Durban agenda on racism and intolerance. The debate showed, broadly, how Durban represented a transformative potential by connecting global racism discourse to the moral status of an embedded postcolonial state. Further, the paper argues that the dominating conceptual focus reflects a paradigmatic individualism, which informs the scholarly approach to modern caste formations. While individualist approaches exclude Dalit rhetoric as subjective, they do not sufficiently acknowledge that the exclusionary logics inflicted on Dalits in modern bureaucratic institutions is a racial dynamic. To shed light on the Durban controversy, the paper outlines the larger background to caste in India and provides examples of Dalit discourse. It also presents the formation of the human rights network and controversial issues regarding the way they define themselves as NGOs, Dalits and Christians. These attributed properties were fundamental for the debate(s). Durban cannot be seen as an episode with tangible empirical impact. Rather, the debate was an intense moment in an ongoing historical argument about hierarchical practices and equality in India as well as about its moral status in the global community. In December 2006, however, at an international conference in New Delhi, the Prime Minister of India compared the Dalit situation to apartheid.
Is the concept of “human security”, which has been discussed and debated in international organizations and academic circles since 1994, simply “hot air”, as its critics claim? Or does it provide a suitable framework for proposing multisectoral, integrated solutions in a world that is increasingly interconnected? While there is no consensus as to the exact definition of the term, human security goes beyond traditional notions of security to focus on such issues as development and respect for human rights. To some the concept is attractive, but analytically weak since it introduces too many variables that are not necessarily linked together. To others, human security concerns should be limited to situations marked by the threat or outbreak of violence. For those who favour a broad definition (as does this author), the human security agenda provides the means to assess the root causes of conflict (whether intra-state or inter-state), to propose adequate policies for resolving crises, and to provide the means for sustainable peace-building. In so doing human security policies focus on social and economic issues as they affect the individual, arguing that security (in the narrow sense of the term) is dependent on a wide-ranging network of factors that require a comprehensive approach to be effective. The paper introduces the various documents on the subject produced by international organizations, takes up the problem of the relation between academic research and policy-making, and points to a certain number of cases in which nations or regional organizations have included human security as a foreign policy option. Throughout the paper reference is made to the case of Afghanistan that is treated in the study reproduced in annex.
Over 140 books concerning Tibet, published between 1980 and 1992, are listed and commented on in this study. The author's purpose is to provide a research tool to enable a critical use of this rich and varied body of literature, particularly as a number of the references cited are somewhat biased. The references are classified by major subject themes under four broad headings: Tibetan culture and tradition; daily life in a timeless Tibet; Tibet in the pre-communist period and the Tibetan communities in exile; conflictual relations between Tibet and the People's Republic of China.
