AI and fundamental rights: a normative framework for biometric identification systems

This seminar will critically assess the regulation of biometric identification systems, such as FRT, within the EU’s evolving AI governance framework. Drawing from Federica’s research in the DigCon project, she will examine how the risk-based approach of the AI Act interacts with existing fundamental rights safeguards under GDPR, LED, and the Charter of Fundamental Rights. Special emphasis will be placed on judicial oversight, procedural safeguards, and the impact of biometric surveillance on democratic freedoms.
Federica Paolucci is a Postdoctoral research fellow in Constitutional Law working at the DigCon project (Digital Constitutionalism: Rights, Remedies, and Policy in the Algorithmic Society) at Bocconi University, Baffi Research Centre. She was awarded a Ph.D. in Constitutional Law at Bocconi University cum laude in 2025. In terms of teaching, she is the Coordinator for the LL.M. in Law of Technology and Automated Systems and Instructor of various bachelor courses, such as Fundamentals of IT Law. She is also the Coordinator of the Legal Clinic with Wikimedia at Bocconi University. Her research revolves around the impact of Artificial Intelligence on the protection of fundamental rights, with a particular emphasis on biometric recognition technologies.
