Descriptif du projet :
Le dispositif de la personne de confiance a été mis en place par les Lois Kouchner (2002), Leonetti (2005) et Claeys-Leonetti (2016). Cette politique de santé établit que lorsqu’une personne est hors d'état d'exprimer sa volonté, le médecin a l'obligation de s'enquérir de la volonté du patient auprès des tiers. En l'absence de directives anticipées, il recueille le témoignage de la personne de confiance ou, à défaut, tout autre témoignage de la famille ou des proches. Cette situation de prise de décision médicale pour autrui est amenée à être de plus en plus présente dans un contexte de vieillissement de la population et de l’accroissement de la présence de troubles cognitifs. L’Ehpad est un terrain majeur de la décision médicale pour autrui par une personne de confiance. En effet, en 2015, 150 000 personnes résidant en Ehpad sont mortes, ce qui représente un quart des décès enregistrés sur l’ensemble du territoire français. Ce projet de recherche a pour objectif l’évaluation des effets du dispositif de la personne de confiance sur la qualité de la prise en charge des patients âgés et dépendants résidant en Ehpad et le bien-être de leurs familles.
