style=\"font-weight: 400;\"> de la Clinique de l\u2019\u00c9cole de droit de Sciences Po est un programme p\u00e9dagogique situ\u00e9 \u00e0 mi-chemin entre cours th\u00e9oriques et travail de terrain. Il s\u2019agit d\u2019une d\u00e9marche empirique fond\u00e9e sur une approche contextuelle du droit. C\u2019est une m\u00e9thode qui s\u2019int\u00e9resse aux \u00ab pratiques du droit \u00bb afin de saisir le droit tel qu\u2019il advient, contrastant avec une approche principalement positiviste qui domine aujourd\u2019hui l\u2019enseignement de la mati\u00e8re. Le droit de l\u2019asile et des migrations constituent \u00e0 cet \u00e9gard un domaine dans lequel cette approche appara\u00eet des plus pertinentes, puisque la condition des migrants met en lumi\u00e8re le foss\u00e9 qui existe entre les instruments de protection et leur application effective.<\/span><\/p><p><span style=\"font-weight: 400;\">Dans ce cadre, les \u00e9tudiants sont recrut\u00e9s pour une ann\u00e9e universitaire afin de r\u00e9aliser des projets construits en partenariat avec des organisations associatives ou des institutions publiques. Ils sont int\u00e9gr\u00e9s dans ces structures et travaillent aux c\u00f4t\u00e9s des salari\u00e9s ou des b\u00e9n\u00e9voles. Les projets sont vari\u00e9s. Il peut s\u2019agir aussi bien d\u2019accompagner des demandeurs d\u2019asile au cours de leur proc\u00e9dure, que d\u2019observer les pratiques administratives ou judiciaires dans un champ particulier (mineurs isol\u00e9s \u00e9trangers, proc\u00e9dures Dublin, acc\u00e8s aux soins, fronti\u00e8res, etc.), ou encore effectuer des missions d\u2019observation en France ou en Europe<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Les objectifs des \u00e9tudiants s\u2019articulent autour de deux axes. D\u2019une part, ils <\/span><i><span style=\"font-weight: 400;\">travaillent<\/span><\/i><span style=\"font-weight: 400;\"> le droit aupr\u00e8s du partenaire, se familiarisant ainsi avec la pratique. D\u2019autre part, ils produisent\u00a0 un rapport concernant directement la mission qui leur a \u00e9t\u00e9 assign\u00e9e par le partenaire (rapport d\u2019analyse, de plaidoyer, proposition de r\u00e9forme, documents pratiques \u00e0 l\u2019usage des publics, etc.). Ils peuvent aussi, parfois, \u00e9tudier l\u2019organisation qui les accueille, son action et son positionnement dans le syst\u00e8me d\u2019aide aux personnes migrantes.<\/span><\/p><p><span style=\"font-weight: 400;\">Au titre de l\u2019accompagnement p\u00e9dagogique, les \u00e9tudiants b\u00e9n\u00e9ficient d\u2019un \u00ab cours-clinique \u00bb enseign\u00e9 par Camille Escuilli\u00e9 et Nicolas Hervieu et d\u2019un cours th\u00e9orique propos\u00e9 par le professeur Vincent Chetail sur le droit international des migrations. Le cours-clinique aborde les grandes th\u00e9matiques du droit des \u00e9trangers et associe de nombreux intervenants ext\u00e9rieurs, hauts fonctionnaires, magistrats, universitaires et associatifs. En parall\u00e8le de leur cours, les \u00e9tudiants s\u2019engagent \u00e0 r\u00e9aliser, au minimum, une demi-journ\u00e9e de travail de terrain aupr\u00e8s du partenaire, en plus de la production du livrable final. L\u2019approche \u00ab clinique \u00bb conduit ainsi les \u00e9tudiants \u00e0 aborder le droit des migrations sous un angle original, le saisir par la pratique du terrain, dans l\u2019id\u00e9e du \u00ab learning by doing \u00bb, et \u00e0 avoir un regard critique sur l\u2019action de l\u2019ensemble des acteurs.<\/span><\/p><p><span style=\"font-weight: 400;\">L<\/span><span style=\"font-weight: 400;\">e collectif MiDi a financ\u00e9 des vacations d\u2019enseignements au sein de la Clinique migrations et d\u2019encadrement de projet p\u00e9dagogique, ainsi que des vacations des \u00e9tudiants et leurs missions de terrain. Les projets et activit\u00e9s p\u00e9dagogiques financ\u00e9s sont les suivants :<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une <\/span><a href=\"https:\/\/www.sciencespo.fr\/ecole-droit\/fr\/actualites\/formation-a-l-ecoute-et-a-l-accueil-des-recits-de-vie\/\"><span style=\"font-weight: 400;\">formation \u00e0 l\u2019\u00e9coute et \u00e0 l\u2019accueil des r\u00e9cits de vie et des s\u00e9ances d\u2019analyse des pratiques <\/span><\/a><span style=\"font-weight: 400;\">pour douze \u00e9tudiants (clinique Migrations\/Acc\u00e8s au droit).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un <\/span><a href=\"https:\/\/www.sciencespo.fr\/ecole-droit\/fr\/actualites\/retour-sur-un-voyage-d-etudes-a-briancon\/\"><span style=\"font-weight: 400;\">voyage d\u2019\u00e9tudes<\/span><\/a><span style=\"font-weight: 400;\"> et observation de terrain \u00e0 Brian\u00e7on (Hautes-Alpes) en novembre 2023 auquel ont particip\u00e9 trois \u00e9tudiants et la tutrice du projet clinique \u00ab Criminalisation des exil\u00e9\u00b7es et des solidaires \u00bb en lien avec l&rsquo;association <\/span><a href=\"https:\/\/tousmigrants.weebly.com\/\"><span style=\"font-weight: 400;\">Tous Migrants<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li><li aria-level=\"1\"><span>La prise en charge d\u2019une offre de vacation \u00ab Soutien \u00e0 un projet europ\u00e9en coordonn\u00e9 par l\u2019association Avocats sans fronti\u00e8res (ASF) dans le cadre de la Clinique de Droit \u00bb (clinique Migrations\/Acc\u00e8s au droit). It emphasizes empirical methods based on a contextual approach to law. Such a method focuses on \u00ab legal practices \u00bb in order to grasp the law as it is, in contrast with the positivist approach which tends to dominate today the teaching of the subject. Asylum and migration law is an area in which this approach seems most relevant, since the condition of migrants highlights the gap between protection instruments and their effective application.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">In this context, students are recruited for an entire academic year to work on projects built in partnership with NGOs\/CSOs or public institutions . They are integrated into these structures where they work alongside employees or volunteers. The projects are varied. It may be to accompany asylum seekers during the asylum procedure, to observe administrative or judicial practices in a particular field (isolated foreign minors, Dublin procedures, access to healthcare, borders, etc.), or carry out observation missions in France or in Europe (Mission carried out in Malta in 2020, at the Slovenian border and in Georgia in 2021 and 2023, and at the French-Italian border in 2019, 2022, 2023 and 2024).\u00a0<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">The students\u2019 work revolves around two axes. On the one hand, they practice law, broadly speaking, within the partner institution. On the other hand, they produce a report related to the mission that the partner assigned them (analysis report, advocacy, proposal for legislative reform, documents or guides for the use of the beneficiaries or volunteers, etc.). They can also study the organization that hosts them, its action, and its position within the field of migrant protection.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">As part of the educational support, students benefit from a clinical course taught by Camille Esculli\u00e9 and Nicolas Hervieu, and a theoretical course on international migration law taught by Pr. Vincent Chetail.The clinical course covers a wide range of issues relating to EU and French Immigration Law, and includes a number of guest lecturers, including senior civil servants, judges, academics and NGO\u00a0 representatives. Alongside their classes, students dedicate at least half a day a week to fieldwork with the partner, in addition to the production of the final report. The \u201cclinical\u201d approach thus leads students to explore migration law from an original angle, to grasp it through practice on the field, thus \u201clearning by doing\u201d, and taking a critical look at what public and private actors do.<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\">The MiDi collective financed teaching assignments at the Migration Clinic and pedagogical project supervision, as well as student assignments and fieldwork. The projects and teaching activities funded thus far are as follows:<\/span><\/i><i><\/i><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.sciencespo.fr\/ecole-droit\/fr\/actualites\/formation-a-l-ecoute-et-a-l-accueil-des-recits-de-vie\/\"><i><span style=\"font-weight: 400;\">Training in listening to life stories, and practice analysis sessions<\/span><\/i><\/a><i><span style=\"font-weight: 400;\"> for twelve students (Migration and Access to Justice Clinics).<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">A <\/span><\/i><a href=\"https:\/\/www.sciencespo.fr\/ecole-droit\/fr\/actualites\/retour-sur-un-voyage-d-etudes-a-briancon\/\"><i><span style=\"font-weight: 400;\">study trip<\/span><\/i><\/a><i><span style=\"font-weight: 400;\"> and field observation in Brian\u00e7on (Hautes-Alpes) in November 2023, involving three students and the tutor of the clinical project \u00ab Criminalisation des exil\u00e9-es et des solidaires \u00bb (Criminalization of exiles and migrant rights activists), in association with <\/span><\/i><a href=\"https:\/\/tousmigrants.weebly.com\/\"><i><span style=\"font-weight: 400;\">Tous Migrants<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">One assignment for the \u00ab Support for a European project coordinated by the association Avocats sans fronti\u00e8res (ASF) as part of the Clinique de Droit \u00bb (Migration\/Access to Justice clinic).
