Anti-bribery and anti-corruption legislation globally have existed for some time, though enforcement actions are rising globally and especially in France where French authorities are becoming more aggressive.
Organizations across every industry should be aware of the consequences and repercussions of corruption violations which can be swift and severe. In the French – and more generally European – context, it is to be expected that more and more companies will be subject to major fines and other penalties that will have highly negative impact on their business and many individual employees could be prosecuted on criminal charges.
This increased prosecution appetite by the likes of Department of Justice in the USA the Serious Fraud Office in the UK and the National Financial Prosecutor’s Office in France as well as the first audits of the French Anticorruption Agency has put anti-bribery and anti-corruption (also known as “ABC compliance”) in the spotlight at companies that operate internationally.
As counsel to many leading companies in their industries, our experience has led us to assist companies before courts or conduct internal investigations, including cases involving allegations of corruption. We also acted for companies which have recently faced audits of the French Anticorruption Agency regarding the implementation and efficiency of their anticorruption compliance program.
Faced with this multitude of standards to be respected, our experience enables us to develop a training course specified to the needs of compliance and non-compliance professionals.
What's the aim of this program?
This program especially aims at improving participants’ ability to: - Understand the drivers of corruption and other related offences; - Strengthen the analytical skills of this complex environment; - Learn about the instruments necessary to develop integrity; The program covers a broad range of topics, including recent developments, stimulating debate, fostering networking, and global exchange of experience. The aim of this training is to providing comprehensive, high-quality and easily accessible anti-bribery and corruption education.
What will it bring to the participants?
Even if we see enhancement in the awareness of the issues related to anti-bribery and corruption prevention it remains difficult to navigate the different standards. We therefore have designed a training program introducing these new compliance issues and providing the participants with practical, real-word insights that will enable them to set themselves as ABC compliance champions.
Why do you think people need to be trained on these topics?
The recent Sapin II law as well as the UK Bribery Act, US Foreign Corrupt Practices Act have transformed bribery and corruption into key topics of corporate governance. This training reinforces ethical and legal obligations while providing the cornerstone for a firm-wide anti-bribery framework. It has for purpose to help the participants and their organisation developing the best practices in order to learn how to fight and resist corruption in your business and strengthen its prevention through mechanisms to reduce risks.
What are the topics studied during those 2 training days?
This Anti-Corruption and Compliance course is intended to familiarize employees with the laws that criminalize bribery and corruption, and to help employees recognize and mitigate associated risks. By the end of the training participants will have an understanding of what constitutes corruption, the consequences of corruption, the international framework of anti-corruption conventions, laws (FCPA, UKBA and relevant national legislation), protocols and best practices, corruption enforcement, high-risk countries, industries and customers, tools and strategies to prevent corruption. Also, we will have a look into responding to the realization of the corruption risks in the course of the operations through governance and corporate strategy issues.

This training will be provided by an enthusiastic team of lecturers who have an abundance of practical experience in the area of anti-corruption and bribery in a wide range of industries. It is dedicated to many people as possible and professionals from all regions of the world, since ABC compliance is becoming an increasingly important issue in everyday life of international firms. As the same time, we see developments of compliance issues towards domestic companies which now have to deal with standards with standards to which they are not used to and have generally few resources to allocate to them. And this trend is transcending all industries. It is certain that professionals at the forefront of these issues, such as compliance officers, compliance and risk program managers, audit managers, compliance lawyers, managers, sales representatives, procurement professionals, but also for consultants and professionals working for government, international organisations or NGOs and who are involved in anti-corruption…

Etienne is a partner in the Dispute Resolution Department of the Paris office of the international law firm Simmons & Simmons LLP. He regularly assists French and international firms, particularly in regulated sectors. He coordinates the firm's Crime, Fraud & Investigations group in Paris. He regularly assists his clients in the context of investigations by enforcement authorities and before courts. He has developed particular expertise in criminal risk management and the implementation of compliance programs in France abroad (whistleblowing procedures, anti-corruption programs).
Alexandre Regniault

Alexandre, partner, heads the Healthcare and Life Sciences sector of the international law firm Simmons & Simmons LLP. He works daily on the legal and regulatory environment of healthcare products and deals with issues related to the relationships between the HLS industry and its stakeholders: healthcare professionals, institutions, health institutions and academics. He is also Vice President of France Biotech.He has extensive experience in the implementation of compliance programs, particularly in anti-corruption regulation specific to the HLS sector.
