Trade Secret Protection: An alternative to IP rights?

Last July, the French parliament passed a new bill implementing the european directive of June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure. Refering directly to the content of the TRIPS Agreement, this new protective regime seems, at first glance, to fit perfectly within the IP system. In fact, the protection of trade secrets set up a totally different legal mechanism which has a complex relationship with IPRs. The discussion will focus on this particular relationship, exploring to what extent the protection of trade secrets could be a valid alternative to IPRs?
